Terms and Conditions – The UGC Lab (India)

Effective Date: 3/10/2025

These Terms and Conditions (“Agreement”) govern your access to and use of The UGC Lab services and website. By engaging with our services as a brand or creator, you agree to the terms below.

 


 

1. Definitions - “We”/“Us”/“Our” refers to The UGC Lab, a business operated in India. - “Brand” means any business or individual purchasing UGC content through The UGC Lab. - “Creator” means individuals providing UGC content through The UGC Lab. - “Services” means connecting brands and creators, collecting briefs, managing deliverables, and delivering content.

 


 

2. Eligibility Users must be at least 18 years old and capable of forming a binding contract under Indian law.

 


 

3. Service Process 1. Brand selects and purchases a content package. 2. Upon payment, a brief form is sent to the registered email. 3. Brand fills the brief, including details like target audience, tone, key messaging. 4. Product is shipped to the creator’s address or digital access is granted (for apps/services). 5. Production begins only after payment is received by THE UGC LAB, brief has been submitted by the brand and the product/access has been received by creators. 6. Content is delivered within 10–12 business days from the date filled brief is received. 7. One revision is included; further edits are chargeable.

 


 

4. Payment & Refund Policy - Payments must be made in full at the time of package selection. - Payments can also be made by contacting The UGC Lab via email to request an invoice. You may also schedule a call or confirm your order through a call and receive an invoice to make the payment. - Production will only commence once full payment is received and the product/ access has been received by the creator. - We reserve the right to issue a partial or full refund if the product or service does not align with our content values or if we are unable to produce the requested videos. - No refunds are issued unless otherwise agreed due to non-delivery. Prices are subject to change without prior notice.

 


 

5. Content Ownership & Licensing - Upon full payment, the Brand obtains rights to use the delivered content. - The Creator waives any moral rights and grants full commercial rights. - Brands may not resell or license the content to third parties unless otherwise agreed. Creators may post the content that they have created for the brand. Brands also have unlimited organic usage rights of the content they receive, but the ad rights is based on the package they purchase. The UGC lab may also use the content created for the brand by the creators to post on The UGC Lab socials.

 


 

6. Creator Obligations - Deliver content as per the brief, timeline, and quality expectations. - Ensure content does not infringe on third-party IP or violate laws. - Include required disclosures (e.g., #ad, #sponsored) as per Indian advertising guidelines. - Creators agree to make any number of revisions and edits requested as long as it aligns with the original brief. Creators give unlimited organic usage rights and 3/6 months of ad rights( based on the contract) of their content to brands and The UGC lab. Creators should refrain from contacting the brands they have worked for through THE UGC LAB during the collaboration period. THE UGC LAB has the rights to post the content created by the creators on THE UGC LAB’s socials/website. THE UGC LAB is not responsible to brands or creators for any non-compliance of the usage rights of the content.

 


 

7. Brand Obligations - Provide accurate, complete briefs and timely access or product delivery. - Use the content within the bounds of the agreed usage rights. THE UGC LAB has the rights to post the content created by the creators for the brands on THE UGC LAB’s socials/website. Brands should abide by the usage rights of the content with the creators based on the product they purchase and will be liable to that to the creators if misused.

 

 


 

8. Limitations of Liability - The UGC Lab is not liable for indirect, incidental, or consequential damages. - Our total liability is limited to the total amount paid for the service.The UGC Lab is not liable for any indirect, incidental, or consequential damages arising from your use of our platform. We do not guarantee the success or outcomes of any campaigns or collaborations facilitated through our platform. The UGC Lab is not liable for any disputes or disagreements arising from collaborations. All content created through collaborations must comply with legal and ethical standards.

 


 

9. Termination We reserve the right to suspend or terminate access to services if a user violates these terms. The UGC Lab reserves the right to terminate or suspend your account at our discretion, without prior notice, for any reason, including violation of these Terms and Conditions.

 

 


 

10. Indemnification Brands and Creators agree to indemnify and hold harmless The UGC Lab from claims, losses, or damages resulting from their content or conduct.

 


 

11. Governing Law & Dispute Resolution These terms are governed by Indian law. Disputes will be subject to arbitration in Chennai, Tamil Nadu, India, in English, per the Arbitration and Conciliation Act, 1996.

 


 

12. Changes to Terms We reserve the right to update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of the revised terms.

 


 

13. Privacy Policy:

Our use of your personal information is governed by our Privacy Policy. By using The UGC Lab, you consent to the collection and use of your information as described in our Privacy Policy.
